1. What are the cookies?
Cookies are small text files that the websites visited by the user automatically send to his terminal (usually to the browser), where they are stored before being re-transmitted to the same sites during a subsequent visit from the same user. About this matter, the protection commissioner has identified on May 8th 2014, two cookies macro-categories: "technical" and "profiling" cookies.
a. Technical Cookies
Technical cookies are those used for the sole purpose of "transmitting a communication to an electronic network, or to the supplier who’s providing the service of the information company only if expressly requested from the subscriber or the service end user".
They are not used for other purposes and are normally installed directly by the website owner or manager. Due to the peculiar intrusiveness that such devices can have in the users private sphere, European and Italian legislation requires that the user must be adequately informed about their use and express his/her valid consent.
2. Subjects involved: publishers and "third parties"
A further thing to take into consideration, in order to give the correct definition of this matter, is the subjective one. It is necessary, to take into account who is the subject installing the cookies on the user's terminal. Whether it is the site manager that the user is visiting (which can be briefly referred to as "publisher") or a different site that installs cookies on behalf of/through the publisher (so-called "third parties").
3. Regulation with simplified procedure and online consent/agreement acquisition
For the purpose of simplifying the regulation, , which is without prejudice to the requirements of art. 13 of the 2016/679 European Regulation, an effective solution is to place it on two levels depth study.
When the user accesses a website, a first "brief" regulation statement must be presented. It should appear on the homepage in a pop-up banner (or other page through which the user can access the site), than supplemented by an "extended" version accessible to the user by clicking on a link.
